Park Rules for Beaulieu Gardens Home Park
Preface
In these rules:
- "Occupier'' means anyone who occupies a park home, whether under an agreement to which the Mobile Home Act 1983 applies or under a tenancy or any other agreement.
- "You" and "your'' refers to the homeowner or other occupier of a park home
- "We" and "our'' refers to the park owner (Beaulieu Gardens Ltd)
- "The park'' refers to Beaulieu Gardens Home Park only. The land outside the boundary wall next to park homes 7, 8, 15 and 16 is Beaulieu Gardens Retreat which is a licensed holiday park and as such has separate applicable park rules.
These rules are in place to ensure acceptable standards are maintained on the park, which will be of general benefit to occupiers, and to promote and maintain community cohesion. They form part of the Agreement by which homeowners occupy the pitch in accordance with the Mobile Homes Act 1983 as amended.
None of these rules is to have retrospective effect. No occupier who is in occupation at the time that the rules come into effect will be treated as being in breach due to circumstances which were in existence on that date and which would not have been in breach of the rules in existence before these rules came into effect.
Occupants
- All occupiers of a Park home must be over 50.
- The letting of homes on the park is prohibited.
- Visitors may stay in the home for a maximum period of 28 days at a time.
- You must not use the park home, pitch or park for any business purpose. You must not use the park home, pitch or park for the storage of stock, plant, machinery or equipment used or last used for any business purpose. You are at liberty to work individually from home carrying out office work of a type which does not create a nuisance to other occupiers and does not involve other staff, workers, customers or members of the public calling at the park or park home.
The condition of the home and pitch.
- Homeowners must maintain the outside of their park home in a clean and tidy condition. Where the exterior is repainted or recovered homeowners must use reasonable endeavours not to depart from the original exterior colour scheme.
- Replacement fences must not be higher than the previous fence and must be constructed using the same style and material as the previous fence.
- New fences (other than replacement fences} must not be higher than 4ft high and must be constructed using the same materials and in the same style as existing fences on the pitch or pitch boundary. Permission to erect a new fence must be sought from the park owner prior to erecting any new fence. Permission to erect a new fence will not be un-reasonably withheld.
- You must not plant trees on your park home pitch.
- Garden shrubs or hedges must not be allowed to grow more than 4 ft high.
- Car ports and garages are prohibited on your park home pitch.
- Garden Sheds must be made of house brick construction, have a flat roof and be no more than 6 ft 8 inches high at the highest point. They must have a floor area of no more than 6.5m2 in total. They must not be erected in any position where they could prevent light to or block views from a neighbours bedroom, lounge or dining room window. No more than1 shed is permitted per pitch. Permission to erect a new shed must be sought from the park owner prior to construction commences. Permission to erect a new shed will not be un-reasonably withheld
- Caravans and boats may not be parked in the separation gap between adjoining park homes.
- Refuse must be stored in appropriate waste bins at all times.
- No washing lines other than folding rotary washing lines are permitted on your pitch. Rotary washing lines must be located in your back garden and folded when not in use.
- Washing must only be hung out to dry on a rotary washing line. Washing must not be draped or hung out anywhere on your pitch or park home, eg: hungover fences, garden furniture, verandas, out of park home windows etc.
- You must not have external fires or use incinerators on the park.
Pets
- No more than 2 dogs, or alternatively 2 cats or alternatively one dog and one cat are allowed to reside in your park home.
- Dogs must be kept on a lead when not on your park home pitch. Dogs must not be exercised on the park.
- Outside dog kennels are not permitted on your pitch.
- External aviaries are prohibited on the park.
Water
- Fire point hoses must only be used in the event of an actual fire. Any other use is strictly prohibited.
- Waste water must not be discharged on to the ground
Fuel
- You may store a maximum of 5 litres of fuel(petrol/diesel etc) only on the park home plot. This must be stored either outside or in a non-flammable construction shed & contained in a fire regulation approved non-flammable storage container. The storage of fuel in or under your park home is strictly prohibited
Vehicles
- The park speed limit is 5mph
- Parking is not permitted on roads and is restricted to parking bays only
- All vehicles driven on the park must be taxed, insured and have a current MOT (where required)
- All persons driving on the park must hold a full driving licence and have valid insurance for the vehicle they are driving.
- Disused or un-roadworthy vehicles must not be kept anywhere on the park. We reserve the right to remove any vehicle which is apparently abandoned.
- You must not allow motor oil, fuel or any other fluid to leak from a vehicle whilst on the park. Vehicles with fluid leaks should be taken off the park premises until the fault is rectified.
- No more than 2 cars are permitted per home pitch.
- Other than for delivering goods and services, you must not park or allow parking of commercial vehicles of any sort on the park including, (Park owned vehicles excluded from rule 8)
- Light commercial or light goods vehicles as described in the vehicle taxation legislation and
- Vehicles intended for domestic use but derived from or adapted from such a commercial vehicle
- Home occupiers may not keep motor caravans on the park. Motor caravans may be parked in the parking space for a period of 24 hours maximum and parked for the sole purpose of loading and unloading.
- You must not carry out the following works or repairs on the park:
- Major vehicle repairs involving dismantling of part (s) of the engine
- Works which involve the removal of oil or fuel or any other fluid.
Misc
- No aerials or antennae are allowed on your pitch other than 1 x tv aerial and 1 x satellite dish. Satellite dishes must not exceed (height 40 cm x 55 cm width).
- Except under the following conditions, the scattering of food for wild birds and animals on the park or anywhere on your park home pitch is prohibited. Conditions : (You may place appropriate garden bird feed on a covered bird table of no more than 2ft maximum length or diameter if circular and you may use appropriate suspended garden bird feeders on your pitch)
