COSAWES PARK RULES
These rules are in place to ensure acceptable standards are maintained on the park, which will be of general benefit to occupiers, and to promote and maintain community cohesion. They form part of the Agreement by which homeowners occupy the pitch in accordance with the Mobile Homes Act 1983 (as amended).
These rules apply to the homeowner or other occupier of a park home. None of these rules are to have retrospective effect. Accordingly:
- They are to apply from the date on which they take effect, which is [TBA dependent upon tribunal appeals]; and
- No occupier who is in occupation on that date will be treated as being in breach due to circumstances which were in existence on that date and which would not have been in breach of the rules in existence before that date.
Reference in these rules to the "Owner" means Cosawes Park Ltd. Reference to "Occupier" or "Occupiers" is used interchangeably and means the person or persons entitled to station and to occupy the Mobile Homes as their main or only residence.
1. Only Mobile Homes of proprietary manufacture, that is to say not home made, which conform to the statutory definition of a Mobile Home contained in the relevant legislation are permitted on the Park (Caravan Sites and Control of Development Act 1960, The Caravan Act 1968, the Mobile Homes Act 1983 (as amended)).
2. Mobile Homes must be kept in a sound state of repair. The occupier must maintain the outside of their park home in a clean and tidy condition. Where the exterior is repainted or recovered occupiers must use reasonable endeavours not to depart from the original exterior colour-scheme. Wheels must not be removed and the Mobile Home must not be repositioned.
3. The occupier is responsible for the cleanliness of the Pitch. He/she must also keep the area underneath the Mobile Home clear and to ensure at all times that he/she is not doing anything which would put the Owner in breach of its Site licence conditions with Cornwall Council or the relevant Site licensing authority.
4. The Mobile Home may be used by the Occupier and members of his/her permanent household and genuine guests only (and in any event for the occupation of such number of persons as shall not exceed the specified number of berths).
5. Occupiers are responsible for ensuring the safety of all electrical, gas and oil installations and appliances to the Mobile Home and to comply at all times with the requirements of the relevant legislation.
6. The Occupier must not permit waste water to be discharged onto the ground. Where water is not separately metered or rated the use of hoses is forbidden, except in case of fire.
7. The Occupier is responsible for all household refuse to be deposited in approved containers which must not be over filled.
8.1 Musical instruments, record players, radios, other appliances, and motor vehicles must not be used to cause nuisance to others, especially between the hours of 10.30pm and 8am.
8.2 Occupiers must not do, or allow to be done, anything on the park which may be a criminal offence.
8.3 Occupiers must not use or display guns, firearms and offensive weapons (including crossbows) on the park and may only keep them on the pitch or in their home if they hold the appropriate license and they are securely stored in accordance with that license.
9. All vehicles must be driven carefully on the park not exceeding the speed limit of 15mph. Occupiers are limited in terms of the number of vehicles they may have to the number of parking spaces available to them. For example, if there is room to park 2 vehicles on their Pitch, they are limited to two. If there is room to park one vehicle on the Pitch but the Occupier has the use of a garage, then two vehicles may be parked on site (i.e. one on the Pitch and one in the garage). In all other cases, one vehicle is permitted. All vehicles must be taxed and insured as required by law and in running order. Drivers must hold a current driving licence and insurance. Disused vehicles must be removed from the park. Occupiers are not entitled to keep commercial vehicles of any size (which includes any vehicle used for the carrying on of a business) on the residential part of the park.
10. Storage sheds, fuel bunkers or other structures must be of a design, size and fabric approved by the Owner.
11. Private gardens which fall outside of the area falling within the boundary of the Pitch and where permitted by the Owner, must be kept neat and tidy. No alterations, including the planting of any trees or shrubs must be made to this area. These private gardens must be handed back to the Owner, on its request or when the agreement under the Mobile Homes Act (as amended) comes to an end. Any future request for a private garden must be made to the Owner in writing who will then respond in writing. The planting of trees on the Pitch is subject to the Owners prior approval of types and position. Trees may not be cut down, removed or damaged on any part of the Park within the control of the park owner.
12. Washing lines are to be reasonably screened from public view.
13. No dogs are allowed. Not more than two cats per household are permitted. Nothing in this rule prevents you from keeping an assistance dog if this is required to support your disability and Assistance Dogs UK or any successor body has issued you with an Identification Book or other appropriate evidence.
14. The Occupier is responsible for the conduct of his/her visitors including children.
15. It is forbidden to carry offensive weapons or other objects likely to give offence on the park, or to interfere with or disturb any flora or fauna on the park.
16.1 Everyone using the park is required to comply with the standards expected by the Site Licensing Authority, currently Cornwall Council, the requirements of the Water Authority or any other statutory requirements including under the Town and Country Planning Act 1990 (as amended)
16.2 Occupiers must notify the Owner if they receive any form of Statutory Notice relating to the Mobile Home and the Pitch.
17. Access is not permitted to vacant pitches. Building materials or other plant must be left undisturbed.
18. No commercial enterprise or business activities shall take place from the mobile home or the pitch.
19. Cosawes Park is a park for those aged 55 years and over. This means that Mobile Homes may only be lived in and used as a main or only residence by persons who have attained the age of 55 years and over.
