PARK RULES FOR HOMESTEAD PARK
Preface
In these rules:
- "occupier" means anyone who occupies a park home, whether under an Agreement to which the Mobile Homes Act 1983 applies, or under a tenancy or any other Agreement
- "you" and "your" refers to the homeowner or other occupier of a park home
- "we" and "our" refers to the Park Owner.
These rules are in place for the good management of the Park and ensuring that acceptable standards are maintained for the benefit of occupiers, and all who use the Park. They form part of the Agreement by which homeowners occupy the pitch in accordance with the Mobile Homes Act 1983, as amended.
With one exception, the rules also apply to any occupiers of park homes who rent their home.
The only rule which does not apply to occupiers who rent their home is Rule 12 relating to the exterior decoration of the home, as they would not be responsible for exterior maintenance.
None of these rules is to have retrospective effect. Accordingly:
- they are to apply only from the date on which they take effect, which is 5 November 2015; and
- no occupier who is in occupation on that date will be treated as being in breach due to circumstances which were in existence on that date and which would not have been a breach of the rules in existence before that date.
These rules also apply (for so long as they live on the park) to the Park Owner and their family, the Park Warden and any employees with the exception of the following Rules 4, 21, 26 and 30.
Occupation of Park Homes
- Occupiers must not take in lodgers.
- You must not reposition the park home.
- You must not make any improvements to the pitch without our prior written approval (which will not be withheld or delayed unreasonably). Any improvement must comply with the Park's site licence and fire safety requirements.
Age of Occupants
- No person under the age of 40 years may reside in a park home, with the exception of the Park owner, their family, the Park Warden and any employees.
Condition of the Pitch
- For reasons of ventilation and safety you must keep the underneath of your home clear and not use it as a storage space.
- Occupiers are not permitted to plant any trees without obtaining the Park Owner's prior written approval as to types and position (which will not be withheld or delayed unreasonably).
- Washing lines must be reasonably screened from public view.
- You must not erect fences, screening or other means of enclosure unless you have obtained prior written approval from the Park Owner (which will not be withheld or delayed unreasonably). Any fencing or other means of enclosure must comply with the Park's site licence and fire safety requirements.
- Occupiers must not lop, top, fell, remove, damage, interfere with or disturb any trees, hedges, boundaries or other flora on the Park.
- You must not have external fires, including incinerators and fire pits. However you are at liberty to use chimineas and barbecues providing they are portable and not homemade.
- You must maintain the open plan style of your pitch.
External Decoration
- Homeowners must maintain the outside of their park home in a clean and tidy condition. Where the exterior is repainted or recovered, homeowners must use reasonable endeavours not to depart from the original exterior colour scheme.
Storage
- Occupiers must not erect sheds, fuel bunkers, and other storage structures without the prior written approval of the Park Owner (which will not be withheld or delayed unreasonably). The design, size, position and standard of any such structures must be agreed with the Park Owner so as to comply with the Park's site licence and fire safety requirements.
- You must not keep flammable substances on the Park except in quantities reasonable for domestic use.
- You must not keep explosive substances on the Park.
Refuse
- Occupiers are responsible for the disposal of all household, recyclable and garden waste in approved containers through the local authority service. You must not overfill containers and must place them in the approved position for the local authority collections.
- You must not deposit any waste or rubbish other than in local authority approved containers on any part of the Park, including any individual pitch.
- Waste matter and other materials likely to block drains, eg toilet wipes, sanitary towels, disposable nappies etc, should not be put down the toilet but wrapped and disposed of in the approved household refuse container.
Business Activities
- You must not use the park home, the pitch, the Park or any part of the Park for any business purpose, and you must not use the park home or the pitch for the storage of stock, plant, machinery or equipment used or last used for any business purpose. However you are at liberty to work individually from home by carrying out any office work of a type which does not create a nuisance to other occupiers and does not involve other staff, other workers, customers or members of the public calling at the park home or the Park.
Noise Nuisance
- You must not use musical instruments, all forms of recorded music players, radios, televisions, garden machinery and other similar appliances and motor vehicles so as to cause a nuisance to other occupiers, especially between the hours of 10.30 pm and 8.00 am.
Pets
- You must not keep any other pets or animals at the park home or on the pitch except the following:
- Not more than 2 domestic cats. You must keep any cat under proper control and must not permit it to frighten other users of the Park, or to despoil the Park.
- Any pets or animals which are housed in a cage, aquarium or similar and remain at all times within your home.
With the exception of any pets or animals owned by the park owner and their family or the park warden.
Note
Rule 21 does not permit you to keep dogs, of any breed, on the park.
- Nothing in these Park Rules prevents you from keeping an assistance dog if this is required to support your disability and Assistance Dogs UK or any successor body has issued you with an Identification Book or other appropriate evidence.
Water
- Occupiers must not discharge waste water onto the ground.
- Homeowners must protect all external water pipes from potential frost damage.
Vehicles and Parking
- AII vehicles must be driven carefully on the Park and within the displayed speed limit.
- Occupiers must not park more than one vehicle on the Park, with the exception of the Park Owner, their family and the Park Warden.
- Other than for loading and unloading, you must not park on the roads. Where you park on the road, for the purpose of loading and unloading, you must not cause an obstruction.
- You must not park on grass verges.
- Occupiers must not park motor homes, touring caravans, trailers, trailer tents or boats on the Park.
- Other than for delivering goods and services, you must not park or allow parking of commercial vehicles of any sort on the Park, including:
- light commercial or light goods vehicles as described in the vehicle taxation legislation and
- vehicles intended for domestic use but derived from or adapted from such a commercial vehicle
with the exception of commercial vehicles operated by the Park Owner, their family, the Park Warden and any employees.
- You must ensure that any vehicles accessing the park, including heavy goods vehicles as described in the vehicle taxation legislation, on your behalf are:
- able to manoeuvre around the park's road and exit without causing an obstruction; and
- do not cause any damage to the park's roads.
- You must hold a current driving licence and be insured to drive any vehicle on the Park. You must also ensure that any vehicle you drive on the Park is taxed in accordance with the requirements of the law and is in a roadworthy condition.
- Disused or unroadworthy vehicles must not be kept anywhere on the Park. We reserve the right to remove any vehicle which is apparently abandoned.
- You must not carry out the following works or repairs on the Park:
- major vehicle repairs involving dismantling of part(s) of the engine
- works which involve the removal of oil or other fuels.
Weapons
- You must not use or display guns, firearms and offensive weapons (including crossbows) on the Park, and you may only keep them on the pitch or in your home if you hold the appropriate licence and they are securely stored in accordance with that licence.
Visitors
- Occupiers are responsible for the conduct of any visitors, including any children. This includes ensuring that all visitors comply with these park rules, the express terms of your Written Statement and the Park's site licence conditions.
Vacant Pitches
- Occupiers must not access vacant pitches on the Park or disturb building materials and other plant on these pitches.
General
- Firefighting equipment situated on the Park must only be used for the intended emergency use.
