PARK RULES for TRELAWNE GARDENS
In these rules:
- "occupier" means anyone who occupies the park home, whether under an Agreement to which the Mobile Homes Act 1983 applies or under a tenancy or any other agreement
- "you" and "yours" refers to the homeowner or other occupier of a park home
- "we" and "ours" refers to the park owner
These rules are in place to ensure acceptable standards are maintained on the park, which will be of general benefit to occupiers, and to promote and maintain community cohesion. They form part of the Agreement by which homeowners occupy the pitch in accordance with the Mobile Homes Act 1983, as amended.
With one exception the rules also apply to any occupiers of park homes who rent their home.
The only rule which does not apply to occupiers who rent their home is rule 2b about the colour of the exterior of the home, as someone renting their home would not be responsible for exterior maintenance.
None of these rules is to have retrospective effect. Accordingly:
- they are to apply only from the date on which they take effect, which is a date 10 be confirmed; and
- no occupier who is in occupation on that date will be treated as being in breach due to circumstances which were in existence on that date and which would not have been a breach of the rules in existence before that date.
1. CONDITIONS
The resident shall conform with all requirements of the planning and licensing authorities. Permission from the owner for buildings etc. cannot be considered as local authority agreement.
2. THE PARK HOME & PITCH
a) For reasons of ventilation and safety you must keep the underneath of your home clear and not use it as a storage space.
b) Where the exterior is repainted or recovered homeowners must use reasonable endeavours not to depart from the original exterior colour scheme.
c) You must not erect fences or other means of enclosure between homes as the park is open plan.
d) You must not, without the prior written consent of the site owner (which must not unreasonably be withheld) carry out any of the following:
i) paving or hard landscaping, including the formation of a pond;
ii) the erection of any pole, mast, wire, dish or communications receiving equipment or any stake penetrating the pitch or park.
3. STORAGE
Where you erect or replace a shed the design, standard and size of the shed must be approved by us in writing (approval will not be withheld or delayed unreasonably). You must position the shed so as to comply with the park's site licence and fire safety requirements.
4. AGE OF OCCUPANTS OF THE PARK HOME
No person under the age of 55 years may reside in a park home, (with the exception of the park owner and their family and/or the park warden and their family).
5. BUSINESS ACTIVITIES
a) You must not use the park home, the pitch or the park (or any part of the park) for any business purpose and you must not use the park home or the pitch for the storage of stock, plant, machinery or equipment used or last used for any business purpose. However you are at liberty to work individually from home by carrying out any office work of a type which does not create a nuisance to other occupiers and does not involve other staff, other workers, customers or members of the public calling at the park home or the park.
b) The mobile home must not be hired and accommodation must not be rented to paying guests.
6. VEHICLES
Parking will only be provided on a permanent basis for one car per home. All vehicles must be driven carefully on the park and not exceed the displayed speed limit. Residents cars must park in their allocated space. Parking of commercial vehicles and trailers, (with the exceptions of commercial vehicles and trailers owned by the park owner and/or the park warden) caravans, motorhomes, and boats is not permitted. Visitors cars must be parked in the visitors car park. All vehicles must be in current use, licensed and covered by the appropriate insurance and MOT requirements for use on a public road. Disused or unroadworthy vehicles must not be kept anywhere on the park. You must not carry out the following works on the park:
a) major vehicle repairs.
b) works which involve the removal of oil or other fuels.
7. PETS
No dogs are allowed. Caged animals/birds outside the home are not allowed. Pets are to be kept under strict control at all times and not cause a nuisance to other residents, their visitors or guests. Residents are responsible for their visitors pets. All visitors dogs are to be kept on a lead when outside the home anywhere on the park and must not be allowed to defecate on the park, in the case of accidents this must be cleaned up immediately.
8. SERVICES
No water hoses are permitted if your home is not separately metered for water.
9. FIRE PRECAUTIONS
For safety reasons external fires, BBQ's and incinerators are not permitted. You must not keep inflammable substances on the park except in quantities reasonable for domestic use.
