Rules for Tamar Park
In these rules:
- "occupier" means anyone who occupies a park home, whether under an Agreement to which the Mobile Homes Act 1983 applies or under a tenancy or any other agreement
- "you" and "your" refers to the homeowner or other occupier of a park home
- "we" and "our" refers to the park owner.
These rules are in place to ensure acceptable standards are maintained on the park, which will be of general benefit to occupiers, and to promote and maintain community cohesion. They form part of the Agreement by which homeowners occupy the pitch in accordance with the Mobile Homes Act 1983, as amended.
With one exception the rules also apply to any occupiers of park homes who rent their home.
The only rule which does not apply to occupiers who rent their home is rule 2 about the colour of the exterior of the home, as someone renting their home would not be responsible for exterior maintenance.
None of these rules is to have retrospective effect. Accordingly:
- they are to apply only from the date on which they take effect, which is 30 December 2014;
and
- no occupier who is in occupation on that date will be treated as being in breach due to circumstances which were in existence on that date and which would not have been a breach of the rules in existence before that date.
These rules also apply (for so long as they live on the park) to the park owner and any employees, with the exception of the following rules: 26.
The Rules have not been compiled to place unnecessary restrictions on residents but rather to ensure that they may live peacefully in unspoilt surroundings. As Park Home residents generally live in closer proximity with other residents than house-dwellers, certain Rules have to be compiled in the residents' interest, others are necessary to preserve the visual amenities of the Park. We are sure that, provided the Rules are accepted in the right spirit, our Parks will continue to be happy and harmonious communities.
1. You must maintain the outside of the park home in a clean and tidy condition.
2. Where the exterior is repainted or recovered homeowners must use reasonable endeavours not to depart from the original exterior colour-scheme.
3. You are reminded that there is no right under your agreement to re-site or re-position the home.
4. No external alterations or additions to the Plot are permitted without the prior written permission of the Site Owner.
5. You must not keep inflammable substances on the park except in quantities reasonable for domestic use.
6. You must not keep explosive substances on the park.
7. The underneath of each Home is to be kept absolutely clear and not used as storage space. This will enable the Site Owner to comply with the conditions attached to the site licence.
8. Trees and shrubs must not be permitted to grow to a size or shape as to cause a nuisance to a neighbour.
9. Fences are not to be erected without the written permission of the Park Owner which shall not be unreasonably withheld or delayed.
10. Existing fences, which fall into disrepair, must be removed and not replaced other than with the consent of the Park Owner. Boundary fences must not be interfered with and no new entrances to the Park should be created.
11. You must not use the park home, the pitch or the park (or any part of the park) for any business purpose, and you must not use the park home or the pitch for the storage of stock, plant, machinery or equipment used or last used for any business purpose. However you are at liberty to work individually from home by carrying out any office work of a type which does not create a nuisance to other occupiers and does not involve other staff, other workers, customers or members of the public calling at the park home or the park.
12. Occupiers shall at all times conduct themselves with due regard to their neighbours.
13. Radios, audio systems, television sets and musical instruments must be kept to a reasonable volume, which does not cause a nuisance to other Occupiers especially during the house of 10.30pm to 8.00am. Motor vehicles, power tools, garden and other equipment must be used so as not to cause a nuisance to any other occupier.
14. External fires, including incinerators, barbeques, chimineas are not allowed.
15. You must not keep any pets or animals except the following:
• Not more than one dog (other than any of the breeds subject to the Dangerous Dogs Act 1991 which are not permitted at all): You must keep any dog under proper control and you must not permit it to frighten other users of the park. You must keep any dog on a leash not exceeding 1m in length and must not allow it to despoil the park.
• Not more than one domestic cat. You must keep any cat under proper control and must not permit it to frighten other users of the park, or to despoil the park.
• Those which are housed in a cage, aquarium or similar and remain at all times within you home.
Note
The express terms of a homeowner's agreement contain an undertaking on the part of the homeowner not to allow anything which is or becomes a nuisance, inconvenience or disturbance to other occupiers at the park and this undertaking extends to the behaviour of pets and animals. A similar requirement not to cause a nuisance applies to tenants and again this includes the behaviour of pets and animals owned by the occupier or their visitors.
Note
These rules do not have retrospective effect. If the keeping of the pet complied with the previous rules, an occupier will not be treated as being in breach when these rules take effect. However, when the pet dies or leaves it can only be replaced if this would comply with these rules.
16. Only one storage shed is permitted on each plot. It shall be of an approved pattern, size and materials and positioned so as to comply with the relevant conditions of the Site Licence. Prior written consent from the Park Owner is required which shall not be unreasonably withheld or delayed. Any form of fuel storage or other structure must have the prior consent of the Park Owner.
17. The Occupier is responsible for the disposal of all household waste in approved containers through the Local Authority service.
18. Garden refuse must be disposed of in a proper manner. Containers must be placed in the approved position for weekly collections.
19. All vehicles must be driven carefully on the Park, not exceeding the displayed speed limit.
20. Parking is not permitted on roads or grass verges. Occupiers and Non Residents authorised to bring vehicles onto the Park do so at their own risk.
21. Vehicles must keep to authorised parking spaces, only two vehicles per plot are permitted.
22. You must hold a current driving licence and be insured to drive any vehicle on the park. You must also ensure that any vehicle you drive on the park is taxed in accordance with the requirements of law and is in a roadworthy condition.
23. Disused or unroadworthy vehicles must not be kept anywhere on the park. We reserve the right to remove any vehicle which is apparently abandoned.
24. You must not carry out the following works or repairs on the park:
(a) major vehicles repairs involving dismantling of-part(s) of the engine
(b) works which involve the removal of oil or other fuels,
25. You are responsible for the repair and maintenance of rented garages. Garage entrances must be left clear at all times.
26. Other than for delivering goods and services, you must not park or allow parking of commercial vehicles of any sort on the park, including:
• light commercial or light goods vehicles as described in the vehicle taxation legislation
and
• vehicles intended for domestic use but derived from or adapted from such a commercial vehicle
27. Touring caravans, motorhomes and boats may not be stored on the Park.
28. Occupiers are recommended to ensure that their Park Home is equipped with a suitable fire extinguisher and fire blanket which conforms to the requirements of the Fire Authority. Chimney flues and cowls must be in good repair. Care must be taken to prevent the discharge of sparks or excessive smoke.
29. Occupiers (and their visitors (which includes visitors' children)) must not use the fire points provided for other than the emergency use intended.
30. No person under the age of 50 years may reside in a park home.
31. Occupiers wilt be held responsible at all times for the conduct of their visitors, including children.
32. Children may not climb trees or banks on the Park and must not be allowed to play around the Mobile Homes of other Occupiers unless invited to do so, neither must they be allowed to play on roads.
33. You must not use or display guns, firearms and offensive weapons (including crossbows) on the park and you may only keep them on the pitch or in your home if you hold the appropriate licence and they are securely stored in accordance with that licence.
34. Access is forbidden to vacant pitches. Building materials or other plant must be left undisturbed.
35. The Occupier must not permit mains or waste water to discharge onto the ground nor permit to pass into water closets, gullies or drains any matter that is likely to cause blockage or damage.
36. You must protect all external water pipes from potential frost damage. You will be responsible for any wastage of water as a result of a failure to protect the pipes
37. The Occupier is responsible for the sewage connection from ground level upwards and for electrical connections from the meter housing.
38. Washing on clothes lines is to be reasonably screened from public view.
39. No tents or awnings may be erected on the Park.
The Park Owner reserves the right to add or amend these Park Rules, as governed and within the procedures set down by the Mobile Homes Act 2013 and the Mobile Homes (Site Rules) (England) Regulations 2014.
