PARK RULES FOR WOODSIDE PARK
Preface
In these rules:
- "occupier" means anyone who occupies a park home, whether under an Agreement to which the Mobile Homes Act 1983 applies or under a tenancy or any other agreement
- "you" and "your" refers to the homeowner or other occupier of a park home
- "we" and "our" refers to the park owner.
These rules are in place to ensure acceptable standards are maintained on the park, which will be of general benefit to occupiers, and to promote and maintain community cohesion. They form part of the Agreement by which homeowners occupy the pitch in accordance with the Mobile Homes Act 1983, as amended.
None of these rules is to have retrospective effect. Accordingly:
- they are to apply only from the date on which they take effect, which is 4th February 2015; and
- no occupier who is in occupation on that date will be treated as being in breach due to circumstances which were in existence on that date and which would not have been a breach of the rules in existence before that date.
These rules also apply (for so long as they live on the park) to the park owner and any employees, with the exception of the following rules - rules 5 & 21, 30 & 31.
The Park Home
- Homeowners must maintain the outside of their park home in a clean and tidy condition. Where the exterior is repainted or recovered homeowners must use reasonable endeavours not to depart from the original exterior colour-scheme.
- Where you employ an external contractor to carry out works to the mobile home or within your pitch, you must ensure that they are competent to carry out those works as well as have valid public liability insurance cover.
- We are responsible for the services to the pitch. You must not therefore disturb, interfere, adjust or add to those services up to the point where they enter your home.
Condition of the Pitch
- For reasons of ventilation and safety you must keep the underneath of your home clear and not use it as a storage space.
- You must not erect fences or other means of enclosure unless they are of 3 feet high x 2 inch wide wooden palings which form part the boundary of your pitch. You may repair and/or replace (in its original position) your boundary fence using materials of a type and size described above. With the exception of park owner's home which has a brick built wall.
- You must not remove any sections of the boundary fence nor create gaps or gateways in the boundary fence. You should main in the boundary fence to a reasonable standard and treat it regularly with a wood preservative preferably of a brown colour.
- You may not erect any additional fencing, privacy screening or other means of enclosure without first seeking our approval in writing (which will not be unreasonably withheld or delayed). You must position any such fencing, privacy screening or other means of enclosure so as to comply with the conditions of the site licence and fire safety requirements.
- You must not erect decking or carry out building works to the pitch without first seeking our approval in writing (which will not be unreasonably withheld or delayed)
- You must not have external fires including incinerators, coal or charcoal barbecues. Gas-fired barbecues are permitted.
- You must not keep inflammable substances on the park except in quantities reasonable for domestic use.
- You must not keep explosive substances on the park.
Storage
- You must not have more than one storage shed on the pitch.
- The design, standard and size of the shed must be approved by us in writing (approval will not be withheld or delayed unreasonably).
- You must position the shed so as to comply with the park's site licence and fire safety requirements.
- The footprint of the shed will be dependent upon the space available on your pitch as well as the conditions of the site licence. In all cases the maximum size permitted shall not exceed 8' x 10'.
- You must not have any storage receptacle on the pitch other than the shed mentioned in rule 12 and any receptacle for the storage of domestic waste pending collection by the local authority.
- You must ensure that any shed or other structure erected in the separation space between park homes is of non-combustible construction and positioned so as to comply with the park's site licence conditions and fire safety requirements. The separation space is the space between your park home and any neighbouring home.
Refuse
- You are responsible for the disposal of all household, recyclable and garden waste in approved containers through the local authority service.
- You must not overfill containers and must place them in the approved position for the local authority collections.
- You must not deposit any waste or rubbish other than in local authority approved containers on any part of the park (including any individual pitch).
Business activities
- You must not use the park home, the pitch or the park (or any part of the park) for any business purpose
- You are at liberty to work individually from home by carrying out any office work of a type which does not create a nuisance to other occupiers and does not involve other staff, other workers, customers or members of the public calling at the park home or the park.
- You must not use the park home or the pitch for the storage of stock, plant, machinery or equipment used or last used for any business purpose.
Occupants of the park home
- No person under the age of 55 may reside in the park home, with the exception of the park owner and their family or a park warden and his family.
- You may accommodate guests under this age for genuine visits.
Noise nuisance
- You must not use musical instruments, all forms of recorded music players, radios and other similar appliances so as to cause a nuisance to other occupiers, especially between the hours of 10.30pm and 8.00am.
- Motor vehicles should not be used so as to cause a nuisance to other occupiers especially between the hours of 10.30pm and 8.00am
Pets
- You must not keep any pets or animals except the following:
- Not more than two dogs (other than any of the breeds subject to the dangerous Dogs Act 1991 which are not permitted at all).
- You must keep any dog under proper control
- You must not permit it to frighten other users of the park.
- When not on your pitch, you must keep any dog on a leash of a length which ensures that you can maintain control of the dog at all times.
- You must not allow any dog to despoil the park.
- Not more than 2 domestic house cats which must be kept in the park home at all times and should not be allowed to wander the park.
- Not more than three birds (of a domestic variety) such as budgerigars, which must be housed in a cage within the park home.
- Nothing in rule 25 of these Park Rules prevents you from keeping an assistance dog if this is required to support your disability and Assistance Dogs UK or any successor body has issued you with an Identification Book or other appropriate evidence.
Water
- You must protect all external water pipes from potential frost damage.
Vehicles and parking
- You must drive all vehicles on the park carefully and within the displayed speed limit of 10 miles per hour, observing 'NO ENTRY' and ' STOP' signs.
- You must not park anywhere except in the designated car parks
- You must not park on the roads for any reason other than loading and unloading.
- You must not park on any communal area of the park except in designated car parks.
- Car washing/cleaning is limited to the car park areas only.
- Other than for delivering goods and services, you must not park or allow parking of commercial vehicles of any sort on the park, including:
- light commercial or light goods vehicles 9s described in the vehicle taxation legislation and
- vehicles intended for domestic use but derived from or adapted from such a commercial vehicle
- motorhomes or caravans of any type
- Rule 30 does not apply to the park owner and their family or a park warden and his family for so long as they live on the park.
- With the exception of the park owner and their family or a park warden and his family, commercial vehicles owned by any contractor employed by you (to carry out works to the home) must park their van in the visitors' car park. In cases where it is necessary for a contractor's vehicle to be parked on the road, please notify us in advance.
- You must hold a current driving licence and be insured to drive any vehicle on the park.
- You must also ensure that any vehicle you drive on the park is taxed, insured and has a valid MOT certificate (if relevant) in accordance with the requirements of law and is in a roadworthy condition.
- Disused or unroadworthy vehicles must not be kept anywhere on the park. We reserve the right to remove any vehicle which is apparently abandoned.
- You must not carry out the following works or repairs on the park including the residents' car park:
- major vehicles repairs involving dismantling of part(s) of the engine
- works which involve the removal of oil or other fuels.
- works which involve the removal and/or the fitting of glass to your car.
- Other types of vehicle repairs are permitted in the visitors car park
- Emergency vehicle repairs may be carried out in the residents' car park in cases where • the vehicle is rendered immobile. When the vehicle is capable of movement it must be removed to the visitors' car park or taken off the park for any further work to be completed.
- One parking space per home is provided in the resident's car park. Home owners with a second car are required to park it in the visitors' car park.
- Visitors must not park anywhere on the park except in the visitors car park.
Weapons
- You must not use or display guns, firearms and offensive weapons (including crossbows) on the park. You may only keep them on the pitch or in your home if you hold the appropriate licence and they are securely stored in accordance with that licence.
Visitors
- You are responsible for ensuring that your visitors and contractors comply with the park rules, conditions of the site licence and fire regulations at all times.
- You are responsible for the conduct of any visiting children and must ensure that they do not play on the park roads, around park buildings, in the car park areas and on any vacant pitches or communal areas.
Safety requirements
- All park homes must be equipped with a fire extinguisher and/or fire blanket which conforms to the requirements of current legislation.
- It is recommended that your park home is fitted with a smoke alarm and a carbon monoxide alarm.
- Red boxes which emit a loud alarm when opened, are strategically placed on the park. They contain two water-filled extinguishers for home owners' use in case of fire emergency. In such an emergency please alert us or our representative as soon as possible.
- Yellow salt/grit bins placed on the park are for use by the home owners on park roads and public walkaways only, in cases of ice and snow.
