PARK RULES FOR STONEYFOLD PARK
Preface
In these rules:
- “occupier” means anyone who occupies a park home, whether under an Agreement to which the Mobile Homes Act 1983 applies or under a tenancy or any other agreement
- “you” and “your” refers to the homeowner or other occupier of a park home
- “we” and “our” refers to the park owner.
These rules are in place to ensure acceptable standards are maintained on the park, which will be of general benefit to occupiers, and to promote and maintain community cohesion. They form part of the Agreement by which homeowners occupy the pitch in accordance with the Mobile Homes Act 1983, as amended.
None of these rules is to have retrospective effect. Accordingly:
- They are to apply only from the date on which they take effect, which is July 15th 2014 for new occupants; and
- No occupier who is in occupation on that date will be treated as being in breach due to circumstances which were in existence on that date and which would not have been a breach of the rules in existence before that date.
Condition of the Pitch
- Occupiers should maintain the plot and home in a tidy condition. For reasons of ventilation and safety you must keep the underneath of your home clear and not use it as a storage space.
- You must not erect fences or other means of enclosure unless you have obtained our approval in writing (which will not be unreasonably withheld or delayed). You must position fences and any other means of enclosure so as to comply with the park’s site licence conditions and fire safety requirements.
- You must not have external fires, including incinerators.
- You must not keep inflammable substances on the park except in quantities reasonable for domestic use.
- You must not keep explosive substances on the park.
Storage
- You must not have more than one storage shed on the pitch. Where you source the shed yourself the design, standard and size of the shed must be approved by us in writing (approval will not be withheld or delayed unreasonably). You must position the shed so as to comply with the park’s site licence and fire safety requirements. The footprint of the shed shall not exceed 48 sq feet (8’ x 6’ typically)
- You must not have any storage receptacle on the pitch other than the shed mentioned in rule 6 and any receptacle for the storage of water collected from rainfall collected from your home’s roof.
- You must ensure that any shed or other structure erected in the separation space between park homes is of non-combustible construction and positioned so as to comply with the park’s site licence conditions and fire safety requirements. The separation space is the space between your park home and any neighbouring home which must not be less than 6 metres.
Refuse
- You are responsible for the disposal of all household and recyclable waste in the Euro bins provided by the Park Owners located above the pond. We also provide bins for glass/cans and flattened cardboard. Garden waste must be taken off site (see clause 10)
- You must not deposit any garden waste or rubbish other than in local authority approved containers at Danes Moss Tip, Congleton Road Macclesfield.
Business Activities
- You must not use the park home, the pitch or the park (or any part of the park) for any business purpose, and you must not use the park home or the pitch for the storage of stock, plant, machinery or equipment used or last used for any business purpose. However you are at liberty to work individually from home by carrying out any office work of a type which does not create a nuisance to other occupiers and does not involve other staff, other workers, commercial vehicles, customers or members of the public calling at the park home or the park.
Age of Occupants
- No person under the age of 50 years may reside in a park home subject to a MHA 1983 Written Statement. Grandchildren are allowed to visit grandparents. Children must be closely supervised at all times and must not be allowed to wander on their own or play ball games etc.

Noise Nuisance
- You must not use musical instruments, all forms of recorded music players, radios and other similar appliances and motor vehicles so as to cause a nuisance to other occupiers, especially between the hours of 10.30pm and 8.00am. No occupier shall do or permit to be done anywhere on the park any act or action which may be or become a nuisance, damage, annoyance or inconvenience to the park owner or to the neighbours or occupiers of any other home on the park, and shall not use or permit the home to be used for illegal or immoral purposes. The park owner shall be entitled to refuse to permit any person to occupy a Lodge on the park, forbid any guest from returning to the park if in the opinion of the park owner these conditions have not been complied with or if there has been any behaviour on the park of any person which in the opinion of the park owner requires immediate removal from the park of such person.

Pets
- Not more than two dogs (other than any of the breeds subject to the Dangerous Dogs Act 1991 or Guarding Breeds which are not permitted at all. You must keep any dog under proper control and you must not permit it to frighten other users of the park. You must keep any dog on a leash not exceeding 1m in length and must not allow it to despoil the park. Dogs must not be left in enclosures/ dog houses/kennels (which are banned anyway) outside the home. Dogs which consistently bark will be regarded as a nuisance and owners will be requested to remove them from the park.
- Not more than one domestic cat which you must keep within the park home.
- Not more than two budgerigars which you must keep within the park home.
- No other pets or animals are allowed
Note
The express terms of a homeowner’s agreement contain an undertaking on the part of the homeowner not to allow anything which is or becomes a nuisance, inconvenience or disturbance to other occupiers at the park and this undertaking extends to the behaviour of pets and animals. A similar requirement not to cause a nuisance applies to tenants and again this includes the behaviour of pets and animals.
Note
These rules do not have retrospective effect. If the keeping of the pet complied with the previous rules, an occupier will not be treated as being in breach when these rules take effect. However, when the pet dies or leaves it can only be replaced if this would comply with these rules.
- Nothing in rule 14 of these Park Rules prevents you from keeping an assistance dog if this is required to support your disability and Assistance Dogs UK or any successor body has issued you with an Identification Book or other appropriate evidence.

Water and Waste water
The occupier must not permit waste water to be discharged directly onto the ground. The washing of cars on the park is strictly forbidden. Disposable nappies, kitchen roll, sanitary towels, cooking oil or fat must not be flushed down the toilet or kitchen drains. Only organic washing agents should be used to ensure the effective operation of the sewerage treatment plant.
- You must only use fire point hoses in case of fire.
- You must protect all external water pipes from potential frost damage.
Vehicles and parking
- You must drive all vehicles on the park carefully and within the displayed speed limit of 10mph.
- You must not park more than two vehicles in the allocated spaces adjacent to your home.
- You must not park on the roads or grass verges.
- You must not park anywhere except in the permitted parking spaces.
- Other than for delivering goods and services, you must not park or allow parking of commercial vehicles of any sort on the park, including:
- light commercial or light goods vehicles as described in the vehicle taxation legislation and
- vehicles intended for domestic use but derived from or adapted from such a commercial vehicle
- You must hold a current driving licence and be insured to drive any vehicle on the park. You must also ensure that any vehicle you drive on the park is taxed in accordance with the requirements of law and is in a roadworthy condition.
- Disused or un-roadworthy vehicles must not be kept anywhere on the park. We reserve the right to remove any vehicle which is apparently abandoned.
- You must not carry out the following works or repairs on the park:
- major vehicles repairs involving dismantling of part(s) of the engine
- works which involve the removal of oil or other fuels.
Weapons
- You must not use or display guns, firearms and offensive weapons (including crossbows) on the park or the remaining land owned by Bollin Stone Co Ltd and you may only keep them on the pitch or in your home if you hold the appropriate licence and they are securely stored in accordance with that licence.
External Decoration and Condition of the Pitch
- Homeowners must maintain the outside of their park home in a clean and tidy condition. Where the exterior is repainted or recovered homeowners must use reasonable endeavours not to depart from the original exterior colour-scheme. No extensions to the home are allowed.
For Timber Clad lodges we recommend only “Technos” top coat when re-protecting the timber.
Park home owners must not, without the prior written consent of the park owner (which will not be unreasonably withheld) carry out any of the following:-
Building works to the park home or the pitch except to the extent to carry out any repairs or maintenance;
Paving or hard landscaping including the formation of a pond; Planting, felling, lopping, topping or pruning of any trees; or The erection of any pole, mast, wire dish or communications receiving equipment.
Liability and Insurance
- The park owner, their employees and agents shall not be liable in any way for actions resulting in death or injury unless arising from their own negligence or other breach of duty.
The park owner, their employees and agents are also not liable for the loss or theft of, damage or loss to or theft from any mobile home or vehicle on the site.
In respect of any loss, damage or liability arising out of the negligence of the park home owner, members of his household, guests or visitors, will not be the responsibility of the park owner and furthermore, the park home owner shall indemnify against any losses thus incurred
If the park home owner is in breach of their Agreement and as a result the park owner incurs costs, the park home owner must pay all reasonable costs resulting from claims, charges and expenses reasonably incurred in relation to the breach of the Agreement.
Park home owners must insure and keep the park home insured with an organisation that is registered with the Financial Services Authority against loss or damage by fire and liabilities to other people and property. The type of loss which is covered should include theft, fire, storm and tempest, etc. The BH&HPA recommend Thistle Insurance Services.
Park home owners must produce a copy of the insurance policy to the park owner upon request together with any evidence that the site owner may reasonably request as proof of insurance.
Bollin Stone Co Ltd and Latevalle Ltd accept no responsibility for any injuries however caused caused within or beyond the park boundaries and to the extent of the total land owned by Bollin Stone Co Ltd
Gas Safety
- Gas Safety in Lodges is of paramount importance. Owners must have their gas appliances certified by a “Corgi” registered installer annually at their expense and to produce the certificate upon request by the park management.
