Trelawne Cottage Gardens Park Rules
Preface
In these rules:
"Occupier" means anyone who occupies a park home, whether under an Agreement to which the Mobile Homes Act 1983 applies or under a tenancy or any other agreement
"You" and "your" refers to the homeowner or other occupier of a park home
"We" and "our" refers to the park owner.
These rules are in place to ensure acceptable standards are maintained on the park, which will be of general benefit to occupiers, and to promote and maintain community cohesion. They form part of the Agreement by which homeowners occupy the pitch in accordance with the Mobile Homes Act 1983, as amended. With eight exceptions the rules also apply to any occupiers of park homes who rent their home. The only rules which do not apply to occupiers who rent their home are rules 2, 20, 23, 54-58 about the texture and colour or maintenance of the exterior of the home, pitch or outbuildings, as someone renting their home would not be responsible for exterior maintenance.
None of these rules is to have retrospective effect. Accordingly: they are to apply only from the date on which they take effect, which is 3rd December 2014 and no occupier who is in occupation on that date will be treated as being in breach due to circumstances which were in existence on that date and which would not have been a breach of the rules in existence before that date.
These rules also apply (for so long as they live on the park) to the park owner and his/her family, with the exception of the following rules 1, 3-9, 11-33, 36-41, 43-52 & 58.
These rules also apply (for so long as they live on the park) to the park owner's employees, the park warden and their families, with the exception of rule 33.
Complying with the Park's Site Licence and Statutory Regulations
1. You must not do, or allow to be done, anything to the home or the pitch which might breach any requirements of Cornwall Council's planning or licensing policies or any other regulations or statutory body.
2. You must at your own expense carry out all works in respect of the mobile home and outbuildings belonging to, or enjoyed with the mobile home, which are required due to an amendment or enforcement notice issued by any statute, government department, local authority or appropriate judicial body.
Condition of the Pitch
3. For reasons of ventilation and safety you must keep the underneath of your home clear of debris and not use it as a storage space.
4. You must not erect fences or other means of enclosure as the park is open plan. Pitches are divided by natural boundaries which are owned and maintained by the park owner.
5. You must not cut or prune any of the park's trees or any hedges separating the pitches.
6. No Trees or shrubs can be planted without the prior written consent of the owner (which must not be unreasonably withheld). Subshrubs and bushes and other annuals and perennials may be planted but rule 7 & 8 must be considered.
7. No tree or shrub can exceed 2m in height or 1m in width/depth.
8. No plants must be allowed to block or encroach on any paths on the pitch or park.
9. Gardens must be weeded regularly and kept neat and tidy including under and around the pitch boundaries.
10. You are responsible for the cost of any damage to the park or pitch, or damage to the services provided by the park, caused by your actions, or the roots of plants or trees planted on your pitch.
11. Lawns must be mowed regularly throughout the year.
12. No grassed areas can be reduced in size or orientation or removed.
13. You must keep all footpaths, patios or paving, handrails and steps on the pitch in a good and safe state of repair and condition.
14. No pressure washer run off or chemicals may be used or allowed to spill on the park's communal roads or footpaths.
15. You must not have external fires, including incinerators & BBQ's.
16. You must not keep inflammable substances on the park except in quantities reasonable for domestic use.
17. You must not keep explosive substances on the park.
18. You must not attach or fix by any means or carry out any works to, the park's boundary stone walls, hedges or fences.
19. You must not do, or allow anyone else to do, anything on the pitch or park which interferes with or prevents the owner from carrying out their legitimate business or park maintenance.
The Park Home
20. You must ensure that:
a) the mobile home at all times complies with the statutory definition of a 'mobile home' set out in the Mobile Homes Act 1983 (or any definition that may subsequently amend or supersede it) and
b) the mobile home is maintained at all times in a condition whereby it is capable of being moved from one pitch on the site to another.
21. You must not, without the prior written consent of the site owner (which must not unreasonably be withheld) carry out any of the following:
a) building works to the mobile home or the base or the pitch repairs or maintenance cared out by you in accordance with clauses 21(c) and/or 21(d) of the Implied Terms of this agreement and any improvements;
b) the erection of any porches, sheds, garages, outbuildings, fences or other structure;
c) make any alterations or build any additions to the exterior of the mobile home or pitch.
d) paving or hard landscaping, including the formation of a pond; or
e) the erection of any pole, mast, wire, dish or communications receiving equipment or any stake penetrating the pitch or park.
In considering any request for consent to carry out any such works, the site owner shall have regard to all the circumstances, including the weight of any proposed works and their likely effect (if any) on the mobile home, the pitch, the base on which the mobile home is stationed and the amenity of the site.
22. The mobile home must not be hired and accommodation must not be rented to paying guests.
23. When the agreement has come to an end (however this may occur) the mobile home must be removed by a competent experienced contractor. You must ensure that the contractor possesses the necessary insurance to remove the mobile home and that they maintain a safe environment for the park and other residents at all times.
Storage
24. You must not have more than one storage shed on the pitch. Where you source the shed yourself the design, standard and size of the shed must be approved by us in writing (approval will not be withheld or delayed unreasonably). You must position the shed so as to comply with the park's site licence and fire safety requirements. The footprint of the shed shall not exceed 3.75m2
25. Replacement sheds can only be erected on existing shed bases. The footprint of replacement sheds shall not exceed 3.75m2
26. You may have one other storage receptacle on the pitch other than the storage shed mentioned in rule 24 and any receptacle for the storage of domestic waste pending collection by the local authority.
27. The second storage receptacle must be positioned at the rear of the property and must not be visible from the park's communal areas. The volume of the 2nd storage receptacle shall not exceed 0.75m3 and must comply with the conditions of the site licence and fire safety requirement.
28. You must ensure that any shed or other structure erected in the separation space between park homes is of non-combustible construction and positioned so as to comply with the park's site licence conditions and fire safety requirements. The separation space is the space between your park home and any neighbouring home.
Refuse
29. You are responsible for the disposal of all household, recyclable and garden waste in bird & animal proof containers with lids or local authority recycling bags/bins through the local authority service. You must not overfill containers and must place them in the local authority approved collection position no earlier than 4 p.m. on the day prior to the local authority specified collection day.
30. You must not deposit any waste or rubbish, other than in bird & animal proof containers with lids or local authority provided recycling bags/bins on any part of the park, entrance drive or parking areas (including any individual pitch).
31. You are responsible for the immediate disposal of any of your household, recyclable or garden waste that the local authority has not taken, on the specified collection day, for whatever reason.
Business Activities
32. You must not use the park home, the pitch or the park (or any part of the park, entrance drive or parking areas) for any business purpose, and you must not use the park home or the pitch entrance drive or parking areas for the storage of stock, plant, machinery or equipment used or last used for any business purpose. However you are at liberty to work individually from home by carrying out any office work of a type which does not create a nuisance to other occupiers and does not involve other staff, other workers, customers or members of the public calling at the park home or the park.
Age of Occupants
33. No person under the age of 52 years may reside in a park home with the exception of the park owner and their family, the park warden any employees or their families.
Noise & Nuisance
34. You must not use musical instruments, all forms of recorded music players, radios and other similar appliances and motor vehicles or permitted pets so as to cause a nuisance to other occupiers.
35. Visitors and/or children are not permitted to play on or around any of the communal areas, other resident's gardens or in the parking areas, drive or entrance.
36. You must not keep any pet or animal at the park home or on the pitch, except those which are intended to be and are permanently housed in a cage, aquarium or similar and remain at all times within your home. For the avoidance of any doubt you must not have or allow cats or dogs on the park.
Rule 36 does not apply to pets owned by the park owner and their family.
37. Nothing in rule 36 of these Park Rules prevents you from keeping an assistance dog if this is required to support your disability and Assistance Dogs UK or any successor body has issued you with an Identification Book or other appropriate evidence. Dogs must be kept under proper control and on a leash not exceeding 1m in length and must not be allowed to despoil any part of the park, pitch or drive or parking areas.
Water
38. You must not use the park's fire point hoses or extinguishers, except in case of fire.
39. You must protect all external water pipes from potential frost damage.
Vehicles and parking
40. A maximum of one parking space for each household will be available on the park, parking areas, driveway or entrance, unless the household has use of a garage or does not own a car.
41. The gated part of the park is a pedestrian only area and no vehicles are allowed. (Except emergency vehicles)
42. You must drive all vehicles on the park carefully and at speeds of less than 5 MPH or within the displayed speed limit.
43. You must not park anywhere except in the permitted parking spaces.
44. Only permit holders can park in the permit-holders parking area. (Parking permits are purchased from the park owner).
45. Visitors and non-permit holders must park in the non-permit holder/visitor parking area.
46. Other than for delivering goods and services, you must not park or allow parking of commercial vehicles of any sort on the park, including: light commercial or light goods vehicles as described in the vehicle taxation legislation and vehicles intended for domestic use but derived from or adapted from such a commercial vehicle with the exceptions of commercial vehicles operated by the park owner and their family, the park warden, any employees or their families.
47. You must not park or allow parking of motorhomes, touring caravans, boats, trailers and vans or similar or any towed unit.
48. You must hold a current driving licence to drive the vehicle on the park. You must also ensure that any vehicle you drive/keep on the park is taxed and insured in accordance with the requirements of law and is in a roadworthy condition.
49. Disused or un-roadworthy vehicles must not be kept anywhere on the park. We reserve the right to remove any vehicle which is apparently abandoned.
50. Vehicles are not allowed to obstruct or prevent the owners carrying out their legitimate business or maintenance of the park.
51. You must not carry out the following works or repairs on the park:
- major vehicles repairs involving dismantling of part(s) of the engine
- works which involve the removal of oil or other fuels.
Weapons
52. You must not use or display guns, firearms and offensive weapons (including crossbows) on the park and you may only keep them on the pitch or in your home if you hold the appropriate licence and they are securely stored in accordance with that licence.
External Decoration
53. You must maintain the outside of your park home in a clean and tidy condition.
54. Where the home's original exterior is painted you must ensure that only pastel paint shades are used when redecorating and therefore the home will remain in-keeping with the other homes on the park.
55. Where the exterior of timber outbuildings/sheds are re-treated/painted you must ensure that only dark brown preservative is used, in-keeping with all of the other timber outbuildings/sheds on the park.
56. Where the home's exterior is re-covered or re-clad you must ensure that the new exterior surface texture & colour matches the original and therefore remains in-keeping with the other homes on the park.
57. Where the home's roof is replaced or maintained you must ensure that the colour matches the original roof colour and therefore remains in-keeping with the other homes on the park.
58. Where the home's skirting is replaced or maintained you must ensure that the colour matches the existing colour and therefore remains in-keeping with the other homes on the park.
